Sections 29-30 of the CBS1 form contain additional provisions and attachments related to the contract. Section 29 includes space to list any additional provisions that have not been approved by the Colorado Real Estate Commission. Section 30 states that certain documents are part of the contract, including the Post-Closing Occupancy Agreement if the corresponding box is checked in Section 17. <br /><br />The next section, titled "Broker's Acknowledgements and Compensation Disclosure," is divided into two parts: A. Broker Working with Buyer and B. Broker Working with Seller. In part A, the broker acknowledges receipt of the earnest money deposit and agrees to release the earnest money as directed by written mutual instructions. The broker also specifies whether they are working with the buyer as a buyer's agent, transaction-broker, or if they have no brokerage relationship with the buyer. The compensation for the brokerage firm is indicated as being paid by the listing brokerage firm, the buyer, or other specified party.<br /><br />In part B, the broker acknowledges receipt of the earnest money deposit and agrees to release it as directed by written mutual instructions. They specify whether they are working with the seller as a seller's agent, transaction-broker, or if they have no brokerage relationship with the seller. The compensation for the brokerage firm is indicated as being paid by the seller, the buyer, or another specified party. <br /><br />Both sections of the broker's acknowledgements and compensation disclosure state that it is for disclosure purposes only and does not create a claim for compensation. Any compensation agreement between the brokerage firms must be separately entered into and is not part of this provision.
