Pdf Summary
Sections 29-End of the CBS1 include additional provisions and attachments for the Apex RES contract. Section 29 contains additional provisions that have not been approved by the Colorado Real Estate Commission. It includes space to list these provisions. Section 30 states that certain documents are part of the contract, including the Post-Closing Occupancy Agreement if it was checked in Section 17.

The next section, "Broker's Acknowledgments and Compensation Disclosure," is divided into two parts: A. Broker Working with Buyer and B. Broker Working with Seller. In part A, the broker acknowledges the receipt of the earnest money deposit. The broker agrees that if their brokerage firm is holding the earnest money, they will release it as directed by the written mutual instructions. The compensation or commission for the broker's firm is to be paid by either the listing brokerage firm, the buyer, or another party.

In part B, the broker working with the seller also acknowledges the receipt of the earnest money deposit and agrees to release it as directed by the written mutual instructions. The broker's role in the transaction can be either a seller's agent or a transaction-broker. The compensation or commission for the broker's firm is to be paid by the seller, the buyer, or another party.

It is important to note that this acknowledgment and compensation disclosure does not create any claim for compensation. Any compensation agreement between brokerage firms must be separate and apart from this provision.
